About the importance of trademarks and why is necessary the Trademarks Registration, we just need to ask ourselves how consumers identify goods and services, how they can associate these goods and services with a specific company, and the answer is simple, they do it through trademarks. Thus, they are the base supporting our client's businesses and we need to extend their protection domestically and overseas.
The trademark protection in the United States is based in a mixed system requiring the use of the mark in the country or at least an intention of use but also allowing international applicants file trademarks based on registrations they already have in their countries of origin with the advantage of obtaining registrations without proving use. This is the reason we have today a hybrid system of trademark protection with requirements of use of the marks but also with some exceptions as trademarks filed based on foreign registrations or extending protection to the country using the Madrid System for International Trademarks.
Trademark Enforcement is the main purpose of protecting marks, and we take proactive measures working with our colleagues overseas to be informed of potential violations of the marks of our clients. We do not wait until one client informs us that they have found counterfeiting goods in any specific jurisdiction. Our purpose is to inform them beforehand, and our colleagues in several jurisdictions are our best resource to accomplish this purpose.
The best action to enforce our clients trademark rights is to work with our colleagues in many jurisdictions to know if the clients’ rights are being infringed. We can not do it without their support.
Trademark protection and registration in the United States is our main purpose. We serve hundreds of domestic and international clients with that purpose. However, we also seek the protection of our client’s marks in other jurisdictions, specially in Latin America and the Caribbean.
This is the region outside the United States where we are more active enforcing our clients trademark rights. We have a network working with our international colleagues in the region to inform our clients of any potential infringement including potential counterfeiting goods in the region’s markets.
